Terms and conditions

1. Purpose

These Terms and Conditions govern the purchase of products through the website https://tienda.lavieya.com (the "Site"), operated by Tever Díaz García, natural person ("La Vieya Asturies"). They apply together with the Legal Notice, the Privacy Policy and the Returns Policy.

2. Nature of the products: print-on-demand manufacturing

The products offered on the Site (t-shirts, hoodies, caps and other merchandise featuring La Vieya designs) are not manufactured in advance or kept in stock: each unit is manufactured specifically after order confirmation, through the manufacturing provider Printful. This feature has relevant legal consequences developed in the right-of-withdrawal section (§8) and in the Returns Policy.

3. Territorial scope

Sales through the Site are made exclusively to mainland Spain and the Balearic Islands. Orders to the Canary Islands, Ceuta or Melilla are not accepted, as the applicable tax regime for those territories (IGIC/VAT exemption) is not currently supported. The purchase system automatically validates the postcode entered and rejects postcodes outside the supported scope.

4. Prices and taxes

All prices shown on the Site are in euros (€), VAT included, at the current general rate of 21% for merchandise items (and 4% for printed books/fanzines, when that product line becomes available). A breakdown of the taxable base and VAT amount is shown for information purposes in the order summary before payment confirmation, without altering the total amount payable.

Shipping costs are calculated and shown separately before order confirmation, and are included in the total consolidated amount charged.

5. Purchase process

The purchase process follows these steps:

• Selecting a product, variant (size/colour) and quantity, adding it to the cart.
• Entering shipping details, contact information (name, email, phone) and tax details (Tax ID) required to issue an invoice.
• Viewing the order summary with a breakdown of subtotal, shipping, VAT and total, and express confirmation by the buyer before proceeding to payment.
• Payment through the Stripe gateway.
• Order confirmation by email, with an order number and access code for later lookup without needing a user account.

The contract is deemed concluded at the moment the buyer receives payment confirmation, in accordance with the general electronic contracting regime under art. 28 of Law 34/2002 (LSSI-CE).

6. Payment method

Payment is made exclusively through Stripe (Payment Intents API), accepting credit/debit cards. The Site never stores the buyer's card data; this is managed entirely by Stripe in accordance with the PCI-DSS standard.

7. Delivery time

The published estimated delivery time is 5 to 10 business days (approximately 2-5 days of made-to-order manufacturing + 2-5 days of shipping), although this timeframe is indicative and may vary depending on the manufacturing and shipping provider.

In any case, and in accordance with art. 66 bis TRLGDCU (Royal Legislative Decree 1/2007), in the absence of an express agreement on delivery time, it may not exceed 30 calendar days from conclusion of the contract, unless otherwise agreed between the parties. If the seller fails to meet its delivery obligation within the agreed period or, failing that, within 30 days, the consumer may terminate the contract under the procedure set out in that article.

8. Right of withdrawal

You have the right to withdraw from your purchase within 14 calendar days of receiving the product, without having to explain why — even a simple change of mind. Each piece is made specifically for you, to order, in the size and colour you chose, but that doesn't take this right away from you: made-to-order manufacturing is a decision we make so we don't hold idle stock, not genuine personalisation. The law only excludes from withdrawal goods made to measure with the buyer's own design (art. 103.c) TRLGDCU) — here the entire catalogue uses La Vieya's fixed designs, and you only choose size and/or colour from a closed list, exactly as when buying standard-sized clothing at any shop.

To withdraw, write to us at [email protected] with your order number, within those 14 days. Return shipping costs are your responsibility (art. 108.3 TRLGDCU), unless we state otherwise expressly. We refund you within a maximum of 14 calendar days from when you notify us, usually once we receive the product back (art. 108.1 and 108.2 TRLGDCU) — using the same payment method as the purchase.

This does not affect your rights if the product arrives defective, if we made a mistake with your order, or if it is damaged in transit — those cases do have a solution, and the procedure is set out in the Returns Policy. It also does not affect the 3-year legal conformity guarantee (section 9).

9. Legal conformity guarantee

Products carry the 3-year legal conformity guarantee set out in arts. 114 et seq. TRLGDCU (as amended by Royal Decree-Law 7/2021 transposing Directive (EU) 2019/771, which extended this period from 2 to 3 years). In the event of non-conformity, the consumer is entitled to repair, replacement, price reduction or contract termination, as legally provided. See the practical procedure in the Returns Policy.

10. Invoicing

At checkout, you provide your Tax ID so we can issue your invoice. The invoice is generated and sent separately from the order confirmation email, from our management system (Dolibarr/Xiringase) — see Privacy Policy, section 4.

11. Dispute resolution

For any dispute arising from the purchase, the consumer may access the EU online dispute resolution platform (ec.europa.eu/consumers/odr), pursuant to Regulation (EU) No 524/2013.

12. Amendment of these terms

La Vieya Asturies may amend these Terms and Conditions at any time. The version in force at the time the order is placed will apply.

13. Current promotions

When the Site offers discount codes or other one-off promotions, the specific conditions of each one are set out in this section while the promotion is active, and are removed once it has ended — whether through the lapse of the announced period, or through early withdrawal decided by La Vieya Asturies at any time — without prejudice to any order already placed keeping the conditions in force at the time it was confirmed.

"San Mateo 2026" campaign — code SANMATEO26 (ENDED, withdrawn before its original end date):

• Current status: this code is **no longer active** on the Site. La Vieya Asturies decided to withdraw it early, before its original end date, as a business decision unrelated to any breach of the conditions set out here (replaced by a donation of 50% of the campaign's actual profit to neighbourhood associations). The conditions below describe the discount **as it worked while it was active**, and are kept here solely as a record for orders already confirmed with that code.
• Scope: the discount applied to the entire Site catalogue available during the promotion period, including the limited-edition "Camiseta San Mateo 2026".
• Amount: 13% off the product subtotal of the order, before shipping costs and taxes.
• What it did not cover: the discount did not apply to shipping costs, which were calculated and charged separately. The total amount payable always included shipping in full, undiscounted.
• Originally announced validity period: from 25 August 2026 to 22 September 2026, both dates inclusive. The code was withdrawn before reaching that end date; outside the effective period of application (whatever the cause) it stops applying automatically.
• How it was applied (while active): the code was entered at the order summary step, before confirming payment; the discount was calculated and shown in the order breakdown before payment.
• Combinability: it was not combinable with any other discount code or promotion, unless expressly stated otherwise when it launched.
• Usage limit: no limit on total uses or uses per buyer while it was active; La Vieya Asturies reserves the right to limit, suspend or withdraw any code at any time — including withdrawal before its original end date, as happened with this one — with no retroactive effect on orders already confirmed.
