Terms and conditions
Purchase conditions: prices, payment methods, made-to-order manufacturing and delivery timeframes.
Spanish is the legally operative version of this document. The Asturian, English and French versions are courtesy translations; in the event of any discrepancy, the Spanish text prevails.
1. Purpose
These Terms and Conditions govern the purchase of products through the website https://tienda.lavieya.com (the "Site"), operated by Tever Díaz García, natural person ("La Vieya Asturies"). They apply together with the Legal Notice, the Privacy Policy and the Returns Policy.
2. Nature of the products: print-on-demand manufacturing
The products offered on the Site (t-shirts, hoodies, caps and other merchandise featuring La Vieya designs) are not manufactured in advance or kept in stock: each unit is manufactured specifically after order confirmation, through the manufacturing provider Printful. This feature has relevant legal consequences developed in the right-of-withdrawal section (§8) and in the Returns Policy.
3. Territorial scope
Sales through the Site are made exclusively to mainland Spain and the Balearic Islands. Orders to the Canary Islands, Ceuta or Melilla are not accepted, as the applicable tax regime for those territories (IGIC/VAT exemption) is not currently supported. The purchase system automatically validates the postcode entered and rejects postcodes outside the supported scope.
4. Prices and taxes
All prices shown on the Site are in euros (€), VAT included, at the current general rate of 21% for merchandise items (and 4% for printed books/fanzines, when that product line becomes available). A breakdown of the taxable base and VAT amount is shown for information purposes in the order summary before payment confirmation, without altering the total amount payable.
Shipping costs are calculated and shown separately before order confirmation, and are included in the total consolidated amount charged.
5. Purchase process
The purchase process follows these steps:
- Selecting a product, variant (size/colour) and quantity, adding it to the cart.
- Entering shipping details, contact information (name, email, phone) and tax details (Tax ID) required to issue an invoice.
- Viewing the order summary with a breakdown of subtotal, shipping, VAT and total, and express confirmation by the buyer before proceeding to payment.
- Payment through the Stripe gateway.
- Order confirmation by email, with an order number and access code for later lookup without needing a user account.
The contract is deemed concluded at the moment the buyer receives payment confirmation, in accordance with the general electronic contracting regime under art. 28 of Law 34/2002 (LSSI-CE).
6. Payment method
Payment is made exclusively through Stripe (Payment Intents API), accepting credit/debit cards. The Site never stores the buyer's card data; this is managed entirely by Stripe in accordance with the PCI-DSS standard.
7. Delivery time
The published estimated delivery time is 5 to 10 business days (approximately 2-5 days of made-to-order manufacturing + 2-5 days of shipping), although this timeframe is indicative and may vary depending on the manufacturing and shipping provider.
In any case, and in accordance with art. 66 bis TRLGDCU (Royal Legislative Decree 1/2007), in the absence of an express agreement on delivery time, it may not exceed 30 calendar days from conclusion of the contract, unless otherwise agreed between the parties. If the seller fails to meet its delivery obligation within the agreed period or, failing that, within 30 days, the consumer may terminate the contract under the procedure set out in that article.
8. Right of withdrawal
In accordance with art. 103.c) TRLGDCU (transposing art. 16.c of Directive 2011/83/EU on consumer rights), the 14-calendar-day right of withdrawal does not apply to products sold on this Site, as they are goods made to the consumer's specifications or clearly personalised, manufactured to order specifically for each purchase.
This exclusion does not affect consumer rights in the case of a defective product, seller error, or transport damage — see full details in the Returns Policy, nor the legal conformity guarantee (§9).
9. Legal conformity guarantee
Products carry the legal conformity guarantee set out in arts. 114 et seq. TRLGDCU (as amended by Royal Decree-Law 7/2021 transposing Directive (EU) 2019/771). In the event of non-conformity, the consumer is entitled to repair, replacement, price reduction or contract termination, as legally provided. See the practical procedure in the Returns Policy.
10. Invoicing
At the end of the purchase, the buyer provides their Tax ID so that a corresponding invoice can be issued in accordance with applicable tax regulations.
11. Dispute resolution
For any dispute arising from the purchase, the consumer may access the EU online dispute resolution platform (ec.europa.eu/consumers/odr), pursuant to Regulation (EU) No 524/2013.
12. Amendment of these terms
La Vieya Asturies may amend these Terms and Conditions at any time. The version in force at the time the order is placed will apply.
